Excavations Materials Contract Determination
New Determination IRC No. 937 of 2013
A new Transport Industry - Excavated Material Contract Determination was made by the Industrial Relations Commission.
Operative Date: 15th August 2014
These are minimum rates and apply only to average conditions encountered. Employers are advised to make due allowance for any conditions of any exceptional nature. The rates and conditions herein are an extract from the Contract Determination.
The contract carrier to be paid one hour travel time at the rate referred to for the appropriate configuration per day.
Contract Rates - As per the Ready Reckoner and measured to the next kilometre. These are minimum rates and it is the responsibility of both parties to ensure all vehicles are legally loaded. (Hourly rate is to be paid, if through slow loading or some genuine reason it is not possible to earn on contract the equivalent of hourly hire).
Extra Capacity - Additional charges apply per cubic metre for extra capacity. For each additional cubic metre add the Extra Capacity rate shown in the Ready Reckoner to the contract rate for the applicable distance travelled.
Minimum Hire - Four hours plus one hour travelling time.
Waiting Time - When the period of time between the arrival on site by the contract carrier and the contractor's departure exceeds ten minutes, time shall be compensated for at the hourly rate.
Travel Time - On all occasions a minimum payment of (1) one hour travel time must be paid for each day regardless of whether any work is performed.

Tolls - All tolls are to be paid by the hirer over and above the minimum rates prescribed above.
Wet Weather - Contract or Hourly Hire
Appearance - 1 hour travelling time if ordered.
Work suspended - No further payment.
Doubtful weather on site - Hourly hire to be paid for instruction to wait due to doubtful weather or site preparation.
Meal Breaks - The hirer may only deduct one half hour meal break per shift from the contract carrier.
Payments - Accounts must be paid for haulage within fourteen days (14) of the end of the month in which the work is completed.
Scope - These rates and conditions apply to all excavation and demolition haulage in New South Wales.
